Last Updated: April 19, 2026

IMPORTANT: BY ENGAGING FIXGI ("Company," "we," "us," or "our") FOR ANY SERVICE—WHETHER RENOVATION, REMODELING, MATERIALS SALES, OR ANY OTHER OFFERING—YOU ("Client," "Customer," or "you") EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. NO SERVICES WILL BE PROVIDED WITHOUT YOUR EXPLICIT CONSENT TO THESE TERMS.

Section 1: General Provisions

1.1 Acceptance of Terms

All services provided by FixGi are subject exclusively to these Terms and Conditions and any signed written estimate or contract for your specific project. No verbal representations, estimates, or promises supersede these written terms. Your signature on any estimate, work order, digital acknowledgment, or payment constitutes irrevocable acceptance.

1.2 Scope of Services

FixGi operates as a full-service home renovation company with the following divisions:

  • FixGi Renovation Services: Kitchen and bathroom remodeling, flooring and painting, whole-home renovations, room additions and basement finishing, and outdoor/deck construction
  • FixGi Materials Shop: Direct sale of flooring, tile, cabinets, countertops, fixtures, and paint at contractor pricing
  • FixGi Materials Marketplace: A peer-to-peer platform where homeowners and contractors buy and sell surplus renovation materials, with escrow-protected payments

1.3 No Implied Warranties

EXCEPT AS EXPRESSLY STATED HEREIN, FIXGI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: Merchantability, Fitness for a particular purpose, Non-infringement, and Workmanship guarantees beyond stated warranty periods.

Section 2: Renovation Services - Terms & Limitations

2.1 Service Area & Travel Policy

FixGi provides on-site consultations and renovation work throughout the Dallas–Fort Worth metroplex.

A. Geographic Service Area

  • On-site service is provided across the Dallas–Fort Worth metroplex, generally within a 50-mile radius of our Saginaw, TX shop (ZIP 76131)
  • Travel fees for consultations and site visits are based on distance from the Saginaw shop and are calculated when the customer provides a project address (see the schedule in 2.1.B)
  • Locations beyond our 50-mile service radius: Not available or subject to negotiated travel fees

B. Travel Fee Structure

Travel fees are measured by distance from our Saginaw shop (ZIP 76131):

Distance from Saginaw ShopTravel Fee
0 – 40 milesFREE
40+ miles$500

Free in-home consultations are provided within our standard service area. Travel fees apply only to work outside that range or to return visits described in 2.2.B.

2.2 Workmanship Warranty

A. What IS Covered

  • Installation labor defects manifesting within the warranty period stated on your project estimate (typically 1 year from completion)
  • Manufacturer defects in materials supplied by FixGi, per the manufacturer's own warranty terms
  • Structural or code-compliance issues resulting from our workmanship

B. What is NOT Covered (Explicit Exclusions)

  1. Travel costs for warranty service visits beyond our standard service area (see 2.1.B)
  2. Damage caused by: Customer misuse or neglect; Settling, moisture, or structural issues unrelated to our work; Pre-existing conditions not detectable during initial assessment; Modifications made by others after our work is complete
  3. Normal wear and tear of materials and finishes
  4. Owner-supplied materials (see 2.4) - defects in materials you provide are the manufacturer's or seller's responsibility, not ours

C. Warranty Claim Process

  1. Customer must notify FixGi within 30 days of discovering a defect
  2. A project manager will schedule an inspection to assess the claim
  3. If validated as a workmanship defect: repair labor is provided at no charge; replacement materials are billed at cost unless covered by the original project scope
  4. If the issue is outside warranty scope, we'll provide a written estimate for the repair

D. Warranty Transferability

Our workmanship warranty applies to the original property and customer and is not automatically transferable to a new owner unless FixGi provides written confirmation of transfer.

2.3 Project Scope & Change Orders

All renovation projects operate on a written, itemized estimate. Any deviation from that estimate - additional work, material upgrades, or scope changes discovered once work begins - requires:

  • A written Change Order signed by both parties before the additional work begins
  • Updated pricing and, where applicable, a revised timeline
  • Payment terms consistent with Section 4

Concealed conditions: Renovation work, particularly in older homes, can reveal conditions not visible during the original estimate (structural issues, outdated wiring or plumbing, water damage, etc.). When this happens, we will stop work, document the condition, and provide a Change Order for your approval before proceeding.

2.4 Owner-Supplied Materials

Customers may supply their own materials for installation. FixGi is not responsible for defects, shortages, or delays related to owner-supplied materials, and installation labor for owner-supplied materials may be billed separately from our standard material-inclusive pricing.

2.5 Permits & Code Compliance

FixGi pulls required permits for projects that need them and performs work to applicable building codes. Permit fees are itemized separately on your estimate. Delays caused by municipal permitting or inspection schedules are outside our control and do not constitute a breach of our timeline commitments.

Section 3: Materials Shop & Marketplace Terms

3.1 Materials Shop Purchases

Materials purchased directly from FixGi's Materials Shop are covered by the original manufacturer's warranty, passed through to you at the time of sale. FixGi does not independently warrant materials beyond the manufacturer's stated terms.

  • Returns of unopened, unused materials are accepted within 30 days with proof of purchase, subject to a restocking fee on special-order items
  • Custom or special-order materials (cut-to-size, custom finishes) are non-returnable
  • Delivery timelines are estimates and may be affected by supplier availability

3.2 Materials Marketplace & Escrow

FixGi's Materials Marketplace connects homeowners and contractors buying and selling surplus renovation materials. FixGi acts as a facilitator and escrow agent for these transactions, not as the seller of record, unless a listing is explicitly marked as sold by FixGi directly.

A. How Escrow Works

  • A buyer's payment, including a 10% buyer protection fee, is authorized and held at the time of purchase
  • Funds are released to the seller once the buyer confirms receipt of the item, or automatically after a defined confirmation window
  • If a dispute is opened before funds are released, payment remains held pending FixGi's review

B. Dispute Resolution for Marketplace Transactions

Buyers may open a dispute if a listing was materially misrepresented. FixGi will review the claim and, at its sole discretion, release payment to the seller or refund the buyer. FixGi is not liable for the condition, accuracy, or legality of third-party listings beyond this escrow and review process.

C. Seller Obligations

Sellers are responsible for accurately describing listed materials, including condition and quantity. Marketplace listings are reviewed before publication, but FixGi does not independently verify every claim made by a seller.

Section 4: Payment Terms

4.1 Deposit & Milestone Requirements

  • Renovation Projects: A deposit is required to reserve your project on our schedule and order materials; the remaining balance is billed at project milestones, as detailed in your written agreement
  • Materials Shop Purchases: 100% payment at time of order
  • Large/Whole-Home Projects: Milestone-based billing tied to defined project phases (e.g., demolition, rough-in, finishes, completion)

4.2 Late Payment Penalties

  • 5 days late: 1.5% service charge
  • 15 days late: Work pauses, $250 resumption fee
  • 30 days late: Collection proceedings, client liable for legal fees

4.3 Refund Policy

NO REFUNDS for:

  • Completed work
  • Special-order or custom-cut materials (non-returnable)
  • Travel fees (incurred regardless of outcome)

Partial refunds (at our discretion) only for:

  • Cancelled projects before work commencement (less 15% administrative fee to cover materials ordering and scheduling)
  • Undeliverable services due to our incapacity

Section 5: Limitation of Liability

5.1 Liability Cap

FIXGI'S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

  • Incidental damages (temporary housing, storage costs)
  • Punitive or exemplary damages

5.3 Force Majeure

FixGi is not liable for delays due to:

  • Weather conditions preventing work or travel
  • Supplier shortages or shipping delays
  • Municipal permitting or inspection delays (see 2.5)
  • Pandemic, epidemic, or public health orders
  • Acts of God, terrorism, or civil unrest

Section 6: Dispute Resolution

6.1 Governing Law

6.2 Mandatory Arbitration

All disputes shall be resolved by binding arbitration under AAA rules. No class actions permitted. Customer waives right to jury trial.

6.3 Attorney Fees

Prevailing party entitled to reasonable attorney fees and costs.

Section 7: Severability & Entire Agreement

If any provision is unenforceable, remaining terms survive. This document, together with your signed project estimate, constitutes the entire agreement between parties, superseding all prior communications.
